Management of Personal Information

When you engage in certain activities with 8 Create we may collect certain personal information from you. These activities including subscribing to electronic and printed newsletters, submitting enquiries and comments on the website, registering your interest for employment or internship, download content, sharing personal data such as logins for hosting, domain registrations, WordPress or other CMS logins, social media platform logins, and any online service requiring a login that 8 Create will assist you in. 

For mail subscribers; the personal information that we collect from you will include your name, title, and email address. We may also collect other personal information from you to enable us to provide you with the requested service.

8 Create will only collect sufficient information necessary to enable us to comply with your request for information. Communications sent through the 8 Create website will be sent to appropriate 8 Create staff for action as needed.

All information collected by 8 Create is necessary to conduct the business of branding, marketing, communications, graphic and web design agency.

8 Create’s use of personal information is limited to the purposes for which it was collected so that we can conduct business and provide our services, except where the individual has agreed to another use.

We also collect personal information to communication new development and relevant information to who have engaged us in business dealings and who have subscribed to our website and/or mailing lists. Some website and/or mailing lists may be monitored for statistical and quality purposes by 8 Create. If, at any time, you do not wish to receive these communications from 8 Create, please let us know or use the unsubscribe features available on different communications.

8 Create will only retain personal information for as long as is necessary, and will then dispose of the personal information securely, in accordance with approved methods. For clients who continue on-going services such as hosting or website maintenance 8 Create may have to keep login info.

Who is your data controller?
8 Create is mostly a one-woman operated business. Wherein, owner; Jacquelyn Tolksdorf will control your data. Should the need (for example custom software development for you website project) to bring in or hire a party or person outside of 8 Create to join the project, they too may need data to perform their hired duty.

Disclosure of personal information

Do you have to provide personal information? Of course, not. However for some projects it is needed. For example if you want 8 Create to transfer your website to 8 Create hosting from your old host; I will need your hosting login, FTP credentials to do so. For some projects, we simply just can’t forward with them unless your provide certain info to get the job done.

8 Create does not sell, trade or rent personal information to any third-party without your consent, except where it is required by law. 8 Create only collects the minimum amount of data needed and have a clear retention policy for the profiles we create.

Security of your personal information

8 Create has a number of security measures in place to protect your personal information. 8 Create recognizes and appreciates the importance of responsible use of personal information collected. You can ask about how we secure personal data or info at any time.

Under the law, you have the right to: seek access to your personal information handled by us; ask us to update or correct your personal information when it is inaccurate, incomplete or out of date; and opt-out of receiving direct marketing communications from us.

If you do not want the information you provide to 8 Create to be used, and you advise us of this preference in writing, we will endeavour to honor your preference.

If you wish to access the personal information that we hold about you, please send us your request in writing. We can provide you with the relevant personal information held by us. We will not charge you for the cost of providing this information

We may also archive non-current records containing personal information for security and administrative purposes, such as back up files. If we do access archived records, we may charge you for the cost of providing of de-archive the requested information (you will be notified of any charges prior to them being incurred).

8 Create does not transfer personal data internationally at this time. Our clients are based in the U.S. for the time being, but should that change this area of the Privacy Policy will be updated.

Do you use personal information to make automated decisions?

8 Create doesn’t often make automated decisions for profiling for marketing purposes, but when we do this in place should we ever decide to. When first chatting with 8 Create please state you do not want to be profiled. An example of how 8 Create could profile you for marketing purposes: ex. I send an email blast to all (for example) author clients about a discount on book cover designs. I do however not profile any businesses or organizations that deal with children, sensitive topics, or vulnerable subject matter.

8 Create has a lawful basis to carry out profiling and/or automated decision-making and document this in our data protection policy.

8 Create sends individuals a link to our privacy statement when we have obtained their personal data indirectly.

8 Create carries out a DPIA to consider and address the risks before we start any new automated decision-making or profiling.

8 Create tells its customers about the profiling and automated decision-making we carry out, what information we use to create the profiles and where we get this information from.

8 Create uses anonymised data in our profiling activities.

8 Create will no longer do automated profiling without your consent. So for example if you are a new client or old client you will receive an email from me asking if you want to receive discounts in the future. You will then be prompted to re-provide your email address and name to be added to a list for discounts. If you don’t want them, no worries. Just let me know!

8 Create carries out processing under Article 22(1) because we have the individual’s explicit consent recorded. We can show when and how we obtained consent. We tell individuals how they can withdraw consent and have a simple way for them to do this.
